Child custody federal lawsuit involves Secretary of Navy
After serving several tours of duty in Iraq and Afghanistan, Staff Sergeant Anthony Rios came back to personal problems with his estranged wife, who is facing assault charges.
Rios’ ex-wife went to the naval command to complain that Rios allegedly abused her and their son. As a result, the military court ruled in favor of his ex-wife and ordered Rios not to have any contact with their son. Although military court records show that the evidence against Rios was insubstantial, he is still being granted little time with his son.
Rios is suing Navy Secretary Ray Mabus, Brigadier General Paul Lebidine and Lieutenant Colonel Dean Schulz for violating his child custody rights. Rios added that he is not after financial damages but wants state custody ruling imposed.
