Spousal support awarded to abusive ex-husband
A California judge has required a rape victim to pay spousal support in the amount of $1,000 a month to her rapist, her former husband. This ruling was met with much trepidation and disgust.
After years of domestic abuse and violence, forced oral sex was the last straw in the marriage. The rape was caught on tape and when charges were pressed, a six year jail sentence was delivered. Their divorce was official in 2010 and the California mother of two is just trying to put this behind her and move on with her life.
Unfortunately, moving on is not currently an option due to the fact she will be required to pay alimony to her ex-husband when he is released. Her yearly salary is substantially larger than her ex-husband’s, which makes him eligible to be given alimony. The original amount, based on their income, would have been $3,000 per month but since he was sexually abusive towards her, the judge reduced the amount to $1,000.
